LIMITED WARRANTY

1. FOLDING BOAT WARRANTY COVERAGE PERIOD
For a period of five (5) consecutive years starting from the date of delivery to the first purchaser, Instaboat® guarantees that each new and unused folding boat sold to the first purchaser by Instaboat® or by any dealer authorized by Instaboat®, will be free from any defects in material or workmanship.

2. OBLIGATIONS OF INSTABOAT®
If, during the aforementioned warranty coverage period, an original part of the folding boat is found to be defective in material or workmanship or both, under normal use and maintenance of the folding boat, Instaboat® will then, at its own discretion, either repair the defective original part in question or replace it with a new genuine spare part, without charge for the necessary spare part and for the labor required to install it, at any dealer or repair facility authorized by Instaboat®.

3. WARRANTY PERIOD FOR LABOR AND SPARE PARTS
For a one (1) year period starting from the signature date of a repair/replacement form, Instaboat® guarantees (i) any new genuine spare part used to replace a defective original part, as well as (ii) any labor with regards to the replacement or repair of any such original part that is defective, performed by any dealer or repair facility authorized by Instaboat®.

4. OBLIGATIONS OF THE FIRST PURCHASER IN THE CASE WHERE THE FOLDING BOAT OR ANY GENUINE SPARE PARTS ARE FOUND TO BEAR FAULTY LABOR OR DEFECTIVE MATERIALS OR WORKMANSHIP
In such a case, the first purchaser must:
a) notify a dealer or repair facility authorized by Instaboat® of the appearance of faulty labor or defects in material or workmanship found in the folding boat or genuine spare parts within seven (7) working days of the appearance of any such defect;
b) present to the dealer or repair facility authorized by Instaboat® this limited warranty and the original proof of purchase of the new folding boat or, as the case may be, the repair/replacement form; and
c) sign the repair/replacement form given by the dealer or repair facility authorized by Instaboat® prior to the beginning of the corrective work, in order to validate the warranty for labor used and for the new genuine spare parts installed during the performance of the corrective work.

5. EXCLUSIONS
The following items are specifically excluded from the warranties identified in provisions 1 and 3 above:
a) normal wear and tear of the folding boat and genuine spare parts;
b) the external protective polyethylene foam strips; rubber handle; straps; and any accessories sold separately from the folding boat;
c) any damage to the folding boat or genuine spare parts caused by failure to provide proper maintenance or storage;
d) any damage resulting from (i) repairs not performed by a dealer or repair facility authorized by Instaboat®; (ii) modifications to the folding boat or genuine spare parts; (iii) use of spare parts not approved by Instaboat®;
e) all types of damage resulting from abuse, misuse, neglect, or racing;
f) all types of damage caused by or resulting from use (i) of an engine or any other propulsion system or equipment; (ii) of any accessories sold separately from the folding boat;
g) all types of damage resulting from accident, fire, theft, vandalism, or any act of God;
h) all types of incidental or consequential damages, or damages of any kind such as, but not limited to, loss of use, towing charges, fees for long distance calls or transportation.


6. LIMITATIONS OF LIABILITY
This warranty grants the first purchaser specific rights and the latter may also have other legal rights which may vary from province to province or state to state. Where applicable, this warranty is expressly given and accepted in lieu of any and all other warranties, expressed or implied, including without limitation, any warranty of marketability or compatibility for any particular use. In no event shall Instaboat® be held liable for incidental or consequential damages. Some provinces or states do not allow the exclusion of incidental or consequential damages, so the above exclusion may not apply. Instaboat® reserves the right to modify this warranty from time to time and at any time, with the understanding that any such modification will not alter the warranty conditions applicable to the folding boat sold or the genuine spare parts installed while this warranty is in effect.

7. NON-TRANSFERABILITY
In the event where the first purchaser sells, assigns, gives, transfers, or otherwise disposes of the folding boat in any manner and for any reason whatsoever, this warranty shall be therefore null and void, the warranty being not sellable, transferable, or otherwise disposable in favor of any subsequent purchaser.
